Terms of Service
Please read these Terms of Service (“Terms”) carefully before using the Evolve mobile application (the “App”) operated by Apparent Group Limited (“Company”, “we”, “us”, or “our”).
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.
1. Medical and Wellness Disclaimer
IMPORTANT: The Evolve App is for informational, educational, and entertainment purposes only.
The App provides content related to spirituality, meditation, and personal growth. It is NOT a medical device, and the content is NOT intended to be a substitute for professional medical advice, diagnosis, or treatment.
- No Professional Advice: Nothing contained in the App should be construed as medical, psychological, or psychiatric advice.
- Consult a Professional: Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical or mental health condition. Never disregard professional medical advice or delay in seeking it because of something you have read or heard on the App.
- Emergency: If you think you may have a medical emergency, call your doctor or emergency services immediately.
2. Accounts and Registration
To access certain features of the App, you may be required to register an account.
- Accuracy: You agree to provide accurate, current, and complete information during the registration process.
- Security: You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
- Eligibility: You must be at least 18 years old to use the App.
3. Subscriptions and Billing
The App offers certain premium features (“Premium Services”) which require a paid subscription.
- In-App Purchases: Subscriptions are purchased via the Apple App Store or Google Play Store (“App Stores”). All billing and transaction processes are handled by the respective App Store.
- Auto-Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- Management: You can manage and cancel your subscriptions by going to your account settings on the App Store or Google Play Store after purchase.
- Free Trials: We may offer free trial periods. If you do not cancel before the trial ends, you will be automatically charged the applicable subscription fee.
- Refunds: Refunds are handled solely by the App Store or Google Play Store in accordance with their refund policies. We do not have the ability to issue refunds directly.
4. Intellectual Property
The App and its original content (including but not limited to text, audio, graphics, design, and software) are the exclusive property of Apparent Group Limited and its licensors.
- AI-Generated Content: The App utilizes artificial intelligence to generate content. This content is owned by us or licensed to us.
- License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use only.
- Restrictions: You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as strictly permitted by these Terms.
5. User Conduct
You agree not to use the App:
- In any way that violates any applicable national or international law or regulation.
- To transmit any unsolicited or unauthorized advertising or promotional material.
- To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
- To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the App, or which, as determined by us, may harm the Company or users of the App.
6. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will Apparent Group Limited, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the App;
- Any content obtained from the App;
- Unauthorized access, use, or alteration of your transmissions or content.
Our total liability to you for any claims arising out of or relating to these Terms or your use of the App is limited to the amount you have paid us in the past six (6) months, or $50 USD, whichever is greater.
7. Indemnification
You agree to defend, indemnify, and hold harmless Apparent Group Limited and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the App, or b) a breach of these Terms.
8. Termination
We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Hong Kong, without regard to its conflict of law provisions.
If you are a consumer in the EU/EEA, you may benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.
